Judiciary must be open to criticism: Madras high court

CHENNAI: Holding that judiciary should be open to criticism and scrutiny, Madras high court Friday rejected a petition filed by YouTuber Savukku Shankar , seeking contempt of court action against DMK neta R S Bharathi for his alleged comments against Justice Anand Venkatesh , reports Sureshkumar K.

"Statements of Bharathi are in the nature of criticism, and judiciary must be a transparent institution that welcomes such criticism," a division bench of Justice S M Subramaniam and Justice V Sivagnanam said on Friday, adding: "Sunlight is the best disinfectant, and the judicial process must be open to scrutiny."

The court observed that the petition filed by Shankar is not maintainable under the Contempt of Courts Act since the state's advocate-general had refused to accord consent to initiate criminal contempt.
